An issue that is starting to crop up is plagiarism by AI/ML algorithms such as large language models, i.e. ChatGPT. These models can only generate content within the scope of their training set. The legal question is whether such scope falls into the legal bounds of plagiarism. An interesting court case in the 1970s may come into play. The case does not appear to be on anyone’s radar yet, but to my thinking, it’s the precedent-setting case that could limit the ability of AI/ML algorithms to create content.
